Editorial

Seit dem letzten Newsletter (Bulletin 06) im Juli 2011 hat sich viel ereignet. Da gibt es Diskussionen um das neue Mediationsgesetz, Fortschritte bei der Etablierung des DFfM, neue Projekte sowie einige Konferenzen, die wir entweder selbst ausgerichtet haben oder an denen wir direckt oder indirekt mitgewirkt haben. Alles hat einen Einfluss auf die Entwicklung der Mediation. Die integrierte Mediation leistet einen aktiven Beitrag.

Since the last newsletter (Bulletin 06) in July 2011, much has happened. There have been discussions about the new mediation law, a continuing progress of establishing the DFfM, which is an umbrella organization, there have been new projects and some conferences that we could join. All these activities have become meaningful in regard of the development of mediation. Integrated mediation is a part of that.

Vision

Der Kongress „Vision Mediation“ am 1. und 2. Oktober hat Maßstäbe gesetzt. Streitige Themen wurden in einer so genannten „Unkonferenz“ auf friedliche, konstruktive und besonders harmonische Weise ausgetragen. Das World coffee, welches von Brigitte Komescher und Arno Baltin moderiert wurde, hat sich bewährt. Die Teilnehmer waren begeistert. Einen guten Einblick hinterlässt das Video, das Hubert Merkel für uns angefertigt hatte (siehe Kongressimpressionen). Den roten Faden bildete die Erarbeitung von Qualitätsstandards, die wir weniger in der Festlegung von Ausbildungsstunden, als in der Definition eines Mediatorenprofils erkennen wollten. Das Ergebnis wird noch ausgewertet und demnächst auf der Webseite veröffentlicht werden.

Our Congress „vision of mediation“ the 1st and 2nd of October has set the standard. Contentious issues were discussed during a so called „unconference“ in a peaceful, constuctive and particularly harmonious way. The World Coffee, which was moderated by Brigitte Komescher and Arno Baltin has paid off. The participants were enthusiastic. A good insight leaves the video that Hubert Merkel had made for us. The common thread was the development of quality standards that we wanted less in the definition of training hours, as seen in the definition of a mediator’s profile. The result will be evaluated and will soon be published on the website.

Austausch

Informieren, austauschen und gestalten ist der Grund, warum wir uns an Konferenzen beteiligen. Es gab viele Konferenzen, mehr als man verkraften kann. Wir waren aktiv mit Beiträgen und Workshops an den Konferenzen in Hannover, in Moskau und in Martinique präsent.

The title of this chapter means exchange. Exchange, inform and shape is the reason why we participate in conferences. There have been many conferences, more than you can handle. We were actively present with contributions and workshops at conferences in Hanover, in Moscow and on Martinique.

  • HannoverWie immer war dieser Kongress thematisch und hinsichtlich der Expertenauswahl gut bestückt. IM war in dem Forum eingebunden, das sich mit der Gesetzgebung auseinandersetzte. Erstaunlich war, dass das BMJ offenbar weniger restriktiv an das Thema herangeht als die anwesenden Mediatiorem im Workshop. Wenn es nach diesen gegangen wäre, wäre sogar eine Verbandsteilnahme gesetzlich vorzuschreiben, ähnlich wie die Zwangsmitgliedschaft bei der IHK. Das wird schwierig, weil die Mediation derzeit als eine Aufgabe gesehen wird, derer sich verschiedene Kammern und Verbände wirdmen. Markant war die Umfrage in einem anderen Workshop, wo 97% der anwensenden Mediatoren meinten, ihre Kollegen seien nicht hionreichend ausgebildet worden.As always, this conference was well stocked thematically and in terms of the expert selection. IM was involved in a forum, which dealt with the legislation. It was astonishing that the Ministry appears to be less restrictive on the subject is approached by the participants of that workshop. If it were up to them, even the mediator’s belong to a professional association should be forced by law, similar to the compulsory membership in the Chamber of Commerce. This might become difficult because the mediation is being seen as a task, which belonging to various chambers and associations. Significantly, the survey of another workshop worked out that 97% of the participants  felt that their colleagues were not trained sufficiently.
  • MoskauDies war eine sehr beeindruckende Veranstaltung unseres Mitglieds und Partners dem scientific center for mediation and law. Viele Experten aus dem In- und Ausland trafen sich, um über die Frage der Implementierung der Mediation in Russland zu beraten. In Russland gibt es seit Kurzem ein Mediationsgesetz.
    This was a very impressive event of our member and partner to the scientific center for mediation and law. Many experts from home and abroad, met to discuss the question of implementation of the mediation in Russia. Russia has recently concluded a mediation law.
  • MartiniqueDiese Konferenz war von der CIMJ organisiert worden. Dies ist ein weltweiter Zusammenschluß von Richtern und Mediatoren im Zusammenhang mit dem Thema der Gerichtsmediation. es hat sich gelohnt teilzunehmen, weil es mal wieder eine hervorragende Gelegenheit gab, sich mit den interkuturellen und internationalen Aspekten der Mediation auseinanderzusetzen.

    This conference was organized by the CIMJ. This is a worldwide association of judges and mediators concerned with court mediation. It was worth it to participate because it was once again an excellent opportunity to deal with intercultural and international aspects of mediation. 

Fortschritt

Abgesandte der IM hatten auch an verschiedenen Veranstaltungen des DFfM teilgenommen. Da gab es Sitzungen des Zertifizierungs- und Qualitätsausschusses und natürlich die Sitzung des Mediationsrates. Der DFfM ist jetzt soweit aufgestellt, um Verbände und Institutionen zu akkreditieren, die ausbilden und ein DFfM Zertifikat vergeben möchten. IM wird ebenfalls ebenfalls die Akkreditierung durch den DFfM nachsuchen.

The title of this section means progress. This concerns the establishment of an umbrealla organization. Emissaries of IM had also participated in various events of DFfM, which is supposed to be one umbrella organization. There have been meetings of the Certification and Quality Committee, and of course the meeting of the Mediation Council. The DFfM is now positioned as far to accredit institutions and organizations that train and certificate Mediators themselves. IM will also be one of them.

Klima

Die Stimmung in der Mediationslandschaft in Deutschland ist durchwachsen. Es gibt weitere, neue Vereinsgründungen und Ausbildungsangebote. So wie es aussieht, werden die B-Verbände sich untereinander annähern und eventuell (spekulativ) fusionieren. Auch das DFfM bemüht sich um ein kooperatives Miteinander. Im Moment stehen überall die eigenen Interessen im Vordergrund. Man ist dabei, sich neu zu formatieren und aufzustellen. Eine einheitliche Dachorganisation ist noch in weiter Ferne. Es ist auch die Frage, ob dies für die Mediation und zur Wahrung ihrer Vielfalt tunlich ist. Gewollt war – von Einigen wenigstens – ein Forum, wo man sich austauschen kann. Hier sollten wir uns ein Beispiel an unseren Kollegen aus Lettland nehmen. Dort gibt es inzwischen einen einheitlichen Mediationsrat, dem ALLE Verbände angehören.

The title of this topic means Climate. In regard of mediation the mood in Germany is mixed. There are new club start-ups and training opportunities. As it stands, the so called B-associations will converge with each other and eventually merge (speculative). Even the DFfM is seeking a cooperative work. At the moment, self-interests are in the foreground. One is to reformat and re-establish the associations. A unified umbrella organization is still far away. The early plan was – at least by some – to establish a forum where you can exchange ideas. Although the associations claim to be such a forum, they are not. Here we should take a lesson from our colleagues from Latvia. There is now a uniform mediation council, which includes ALL the associations.

Auch hinsichtlich der Gesetzgebung ist die Stimmung durchwachsen. Es gibt viele Enttäuschungen und unerfüllte Erwartungen. Der Gesetzgeber will die außergerichtliche Mediation fördern. Er wird deshalb die Gerichtsmediation nicht erlauben. So wie es aussieht kann dies ein Bärendienst sein. Gefördert wird die Stellung der Anwaltschaft. So jedenfalls die Sichtweise Einiger. Unser Mitglied Bernd Bohnet hat die Gesetzgebung akribisch verfolgt (Beobachtung des Gesetzgebungsverfahrens) und kommentiert.

Also in terms of legislation, the mood is mixed. There are a lot of disappointment and unfulfilled expectations. The legislature intends to promote the non-judicial mediation. Tt will therefore not allow court internal mediation. So it looks like this is a disservice. The program supports the position of the legal profession. Our member Bernd Bohnet has meticulously followed the law (observation of the legislative process) and commented it step by step.

Initiative

Nach den Aktivitäten der Regionalgruppe in München hat sich die Regionalgruppe Frankfurt gegründet und bereits mit 2 Veranstaltungen Aufmerksamkeit erregt.

This is of a local meaning. After the activities of the regional group in Munich, Frankfurt, the regional group founded and already attracted attention with two events.

Apropos Neugründung: In der Schweiz gibt es jetzt einen eigenständigen Schwesterverein Integrierte Mediation / Schweiz. Wir beglückwünschen die Kollegen in der Schweiz zu diesem Schritt.

This is of an international meaning. Speaking of Start-Up: In Switzerland, there is now an independent sister organization integrated mediation / Switzerland. We congratulate our colleagues in Switzerland to take this step.

Sterne

In Lettland hat die Ausbildung zum 2 Sterne Mediator begonnen. Obwohl eine zugesagte finanzielle Unterstützung ausgefallen war, konnte unser lettischer Schwesterverein den Kurs aus eigener Kraft auf die Beine stellen. Mit 20 Teilnehmern ist der Kurs voll besetzt. Die Ausbildung erfolgt nach den IM Standards und in Anlehnung an das Curriculum der ZFH Ausbildung. Sie wird bis September 2012 andauern.

Sterne means stars. Stars are the mediator’s degrees given by IM. Now also in Latvia, the training has begun for two star mediator. Although a pledged financial support had failed, our Latvian sister association could offer the course on their own. With 20 participants the course is full. The training follows the IM standards and in accordance with the curriculum of training ZFH. It will last until September 2012.

Maßstab

Unser Projekt EuroNetMed ist angelaufen. Zusammen mit PAMB, GEMME und IM erarbeiten wir Standards für eine Ausbildung in grenzüberschreitender Mediation. Wir bemühen uns, ein Netzwerk aufzubauen und eine zentrale Anlaufstelle für internationale und interkulturelle Mediationen einzurichten. Obwohl wir alle Verbände eingeladen hatten mitzuwirken ist die Resonanz sehr zurückhaltend. Woran das wohl liegen mag?

Maßstab means Scale. It might be given by our EuroNetMed. It is on the way. Together with PAMB, GEMME and IM, we develop standards for training in cross-border mediation. We strive to build a network and establish a central contact point for international and intercultural mediation. Although we had invited all associations to participate, the resonance is very restrained. What might be the reason for that?

Dort finden Sie die neuesten Nachrichten. Die Beiträge sind (und werden noch, soweit noch nicht geschehen) den Menüpunkten zugeordnet. Beiträge über das Mediationsverfahren finden Sie also auch unter dem Menüpunkt Mediation/Verfahren aufgelistet. Unsere Webseite gilt zur Zeit als eine der aktivsten im Bereich der Mediation. Sie können sich – falls noch nicht geschehen – einen Feed abonnieren oder den Newsletter zeichnen. Es lohnt sich!

This topic concerns optimization. We steadily try to do so. Our web site has been optimized. The site consists of a BLOG (news) and a CMS (Content Management System) at the same time. The BLOG witll be accessed by the address www.in-mediation.eu. There you will find the latest news. The contributions are assigned to the menu items. Thus you have an actual and logical access to each post.

Die englischsprachige Version ist bereinigt worden und sieht jetzt besser aus. Die lettischsprachige Version ist noch work in progress. Hier warten wir auf den Input unserer Kollegen in Lettland. Die englische Version der Webseite wird mit www.in-mediation.eu/en/ gestartet.

The English version has been cleaned up and now looks better. I think it more and more becomes worth to sign the newsletter or to visit our page even if you are abroad and not speakimng German. The Latvian-version is still a work in progress. Here we are waiting on the input from our colleagues in Latvia. The English version of the website is started with www.in-mediation.eu/en/.

Um Ihnen noch mehr gezielte Informationen zukommen zu lassen, haben wir auf der Webseite Fragen und Antworten Verzeichnisse eingestellt, sogenannte FAQ Listen. Weil Videos so aussagekräftig sind, haben wir jetzt einen Youtube Kanal. Dort finden Sie zum Beispiel die Vorlage für ein kostenloses Infogespräch in Familiensachen, das Video zum Kongress und nun auch das Video zum systemischen Konsensieren.

Because videos are so informative, we now have a Youtube channel. There you will find, for example, the template for a free information meeting on family matters, the video for the Congress and now the video for systemic Consensing.

Wahrnehmung

Was nutzt es, wenn wir eine hervorragende Ausbildung bieten, aber niemand unsere Mediatoren kennt? Das ändert sich jetzt, denn wir haben endlich ein funktionierendes IM-Mediatorenverzeichnis. Sie finden jetzt auf unserer Webseite alle IM Mediatoren. Genauer gesagt, sie können sie dort finden. Voraussetzung ist  natürlich deren Eintragung. Das Formular ist im Intranet und steht nur IM Mitgliedern zur Verfügung. Das besondere an dem Verzeichnis ist, dass Sie zugleich bei dem größten Suchportal für Mediatoren eingeschrieben und gelistet sind. Um Ihnen eine möglichst flächendeckende Präsenz zu gewährleisten, haben wir nicht nur mit mediator-finden.de sondern auch mit Accanis eine Vereinbarung getroffen, die es unseren Mitgliedern ermöglicht sich zu Sonderkonditionen dort listen zu lassen.

This chapter is named perception. What use is it if we offer an excellent education, but no one knows our mediators? That changes now, because we finally have a functioning IM mediator directory. You can now find on our site, every IM mediators. More precisely, they can find them there. Prerequisite course is its registration. The form is only available on the intranet and meets IM members. The special feature of the directory is that you are also enrolled in the largest search portal for Mediators listed. In order to ensure a nationwide presence, we made agreements with finden.de and Accanis that allow our members to be listed for special conditions.
